Marriage License — help? K1 Visa

Hello! I’m honestly not sure if someone can help me or
not.

My fiancé is from England and is here on a K1 visa. We went and applied for him to get a SSN on May 17. They have to verify his documents with DHS before issuing a number.

Everything I’ve read states that foreign fiancés on visas do not need to have a social security number to get the marriage license, they just need to show proof of being here legally (I94, K1 Visa, Passport). However, my local town office (Winterport) is refusing to give us a marriage license without his SSN. It can take 4 to 6 weeks to get an SSN (from what I’ve seen) and we want to get legally married June 26.

Is my town office correct in refusing to give us a marriage license? I’m stressing out because the wedding is in 4 weeks and 2 days and I don’t know if he’s even going to have his SSN by then. Does anyone have any experience with this?

    Hey Tiffani! Unfortunately what was true for me might not be true for your town, as each county's marriage laws are different and they can enforce them however is right for them. For me, no, my British DH did not need a SSN or proof of residence/citizenship/visa for us to get married, but that might be the law/policy where you are. The best thing you can do is look through their website and check on their particular rules.

    Also adding — our town issued a marriage license after I called the capital and they confirmed he doesn’t need a SSN.

    So after you started the K1 visa process was your fiancé able to male short visits to you? My biggest concern is that once I start the K1 visa process he is going to have trouble visiting me while the visa is pending. Also did you guys hire an immigration lawyer? And how quickly was your K1 visa processed. And when your fiancé visited you before applying for the K1 visa did he let board and customs know he was visiting his girlfriend and did that raise any red flags? Thanks so much in advance! My fiancé is a French citizen so he travels on an ESTA

    Hi,

    i have heard that your fiancé should stay put until the K1 process is over. That’s the plan for me and my fiancé. Each time he has visited me he has stayed longer and longer and his last visit was for 2 months and customs gave him a hard time. They stamped his passport and said he had to depart in 2 months and not to make any plans to stay longer otherwise they would take his visa away.
