Change last name in Minnesota, Getting Married in South Dakota

Amanda, on June 24, 2021 at 11:21 AM Posted in Minnesota Planning 0 9

I've having trouble figuring out what steps to do first. I'm getting married in South Dakota but I am a resident of Minnesota. On the South Dakota Marriage License application, do I need to write my new last name, or write my current last name since technically my new name doesn't exist yet?

I also heard that in Minnesota you need to have your own court hearing to change your name? Others are saying that their MN marriage license already had their new last name on it, but since i'm getting married in SD I'm worried that the processes won't be as easy since its two different states.

I would be surprised if you needed a court hearing for a name change due to marriage.
To change your name at the Social Security office, they just need ID and your marriage license. Once your SSN is changed, that’s your name. You use the SS card to change your license, etc.

The license application may have a line for intended last name after marriage (mine did). Just look at the wording of the application and fill it out accordingly. You can also ask the clerk while you are there. Also if you're traveling for your wedding make sure you check to make sure you have enough time to get the license. I got married in MA and theres a 3 day waiting period for it to be valid so we actually got our license a month in advance because it was good for 60 days. Otherwise we wouldn't have been in town early enough to get the license the weekend of the wedding!

Hi! I live in MN and just went through the process having gotten married outside of MN. I did not file anything in MN. On my Jamaican wedding certificate it lists my old last name and nowhere on there did it ask what I wanted it to be. When I went to change it I filled out the SS name change form with what I wanted and mailed everything in. They went based off the form. In MN you have to do SS first 😊 I hope that helps! If not feel free to let me know!

I am a resident of MN, and I got married here. If your SD license asks for name before and after marriage, once you get your original with a raised seal, take that with you EVERYEWHERE to request a name change. Make copies, front and back, to mail to credit card companies, etc. And this may make you nervous, lol, but bear with me: Mail the items you need to the Social Security office. Going there on Chicago Avenue will take five hours, I am not kidding. You will get everything back first, then about a week later you will get your new SS card. I had to mail in my birth certificate, my divorce decree (I took back my maiden name) and my lone certified original marriage license. Talk about sweat! It was no issue at all! And please don't let some company charge you to do this for you - it is not that hard, just kind of tedious. Best wishes from the Land of 10,000 Lakes!!! Smiley heart

Hey Amanda, did you get your name changed yet in MN? I am getting married in less than 3 weeks in Florida and from what I’m looking at on MN judiciary website it is asking for a court hearing and 2 witnesses. Wondering whether that’s necessary or follow others advice on just changing SS card with the new name

After doing more research I’ve found that as long as you are changing your name due to marriage, a court hearing is not needed! You just need to fill out a name change application for a social security card and go from there!
