Catering Estimates and advance payment?

Hi,


Initially when planning my wedding, we anticipated a guest count of 275, we signed our contract to our venue with an full payment of about 49k, based on catering estimate.
However, we’ve dropped our count to 200 and let the venue know about a month in advance. They adjusted our numbers, however they’re saying that the advance payment of 49k will still be required even though, we’re actually only having 200 guests and it’s about 40k now.
They’re saying advanced payment was non refundable, but we thought that was the deposit amount of 35% that we paid at signing (about 18k).
We dropped on our f+b minimum as a result and now have to pay an additional 2k towards that which I understand, but I don’t understand why I’m paying for additonal seats that I’m not filing with advanced notice.
How is this legal? Due to issues with venue, I didn’t get to sign with them until three months before my wedding and a lot of my guesta couldn’t attend due to delayed notice.
Any advice on how to fight this before we have to pay them?My wedding is on Sunday

    It's really short notice to the venue to cut the list by that many, but what does your contract say? Everything important is in the contract.

    Sometimes when this happens, the venue will agree to upgrade certain aspects of the catering to account for the smaller number of guests, leaving the total the same. I'd ask about that.
